The right to beauty between instances of protection and inclusiveness
Abstract:
The subject of the Project is the formulation of a right to beauty. To date, in fact, there is no unambiguous normative definition on the subject.
Beauty, like any other value, cannot be inculcated and no one can replace the individual in his or her realisation as a person. What we propose to do is to enucleate from the fundamental principles of the Constitution - and, in particular, from those of liberty, equality, solidarity, dignity of the human person, cultural development, memory and identity - all the rights that give effect to them, and to fully fulfil the task of making them effective. In fact, rights, not being a closed catalogue, are redesigned every day, depending on the obstacles, opportunities and challenges to which rapid change continuously exposes the lives of individuals and communities.
The experience of beauty accompanies our daily lives: it can be the protagonist, but it can also be a backdrop for other actions experienced in the foreground. In both cases, this should not be a lowering of the protection and attention to be paid to all our cultural heritage.
Beauty, in fact, is linked to a contemplative dimension of life and refers to the profound meaning of being in the world of each and all. The project, therefore, is rooted in factual reality. The growing demand for art, music, landscape, literature, in a word 'beauty' has directly to do with the sense of belonging, identity and memory, with human well-being and the quality of life of individuals and communities. It mirrors, therefore, a citizenship 'pleno iure' from which no one should be excluded. The aim of the research will therefore be to recognise, also at a legal level, the impact that beauty has in the formation and development, not only of individuals, but of the entire community. In order to achieve this objective, it will be inevitable to adopt a multidisciplinary approach. With this in mind, the Project will not limit itself to dealing with issues from a purely legal point of view. Being a transversal theme, the work will involve different branches of knowledge, ranging from law, art, economics and architecture. There will also be comparative profiles aimed at highlighting the approach to the topic in the context of international conventions.
Ultimately, starting from the study of the theme, we will arrive at mapping a new right to beauty that is inclusive and internationally constructed. Starting from this basis, research perspectives aimed at investigating its protection, focusing in particular on the study of patents, and its application in the form of urban regeneration will take shape, since, as mentioned above, beauty stimulates not only the growth of individuals, but of all communities.
