The dark side of the laws against human trafficking: the need for a new, not exclusively criminal approach in a global world perspective

Abstract

Human trafficking is a question cannot be solved by a mere criminal law point of view. The dark side of the law is that in reality instead of a punishment against criminals, we have increased the punishment of the irregular or clandestine migrants I.e. The real victims. On the contrary, we need a different loom providing for massive international cooperation and collaboration with the weak and developing countries; we also need to fight the irregular immigration not only with a narrow criminal law or statutory approach, but also in a multidisciplinary way using the instruments offered by private law and European and international law as for instance the consumer protection or competition law or tax law. Further I suggest to abolish any kind of restrictions and limits to immigration trying to control it in a different and more useful way
