Abstract

This paper aims to analyze the global disaster caused by the COVID-19 pandemic that has disrupted the existence of almost all of humanity. In addition, examine the significant limitations limitations on individual and collective freedoms to protect public health and, secondly, to mitigate as much as possible the impact of the pandemic on economic activities. The attention of the article focuses exclusively on the rules that impact on the general discipline of obligations and contracts, ignoring the very important provisions on labor relations, loan contracts, banking and insurance contracts, etc. It will verify to what extent the social, health, economic and institutional situation determined by the pandemic represents a state of emergency, not unlike the post-war periods, but which should not and cannot be considered a state of exception.
