L’esecuzione delle sentenze della Corte europea dei diritti dell’uomo: vecchi problemi nei nuovi orizzonti

Abstract

The contribution aims to examine the complex issue of the execution of the judgments of the European Court of Human Rights within the Italian legal system. Starting from a comprehensive examination of the most significant case law on the subject, the paper focuses on the difficult interaction between the principles set by the Strasbourg Court and the national application of these principles. In particular, it is intended to critically explore the dynamics and challenges associated with the adaptation of European rulings in the Italian legal context, highlighting the many problems that still remain in the legal system despite the introduction of new ad hoc regulatory instruments.
