Abstract

The Supreme Court, in a wide-ranging judgment, clarifies the meaning of the “knowledge indicators” codified in Article 420-bis, § 2, of the Italian Criminal procedure code. An interpretation “guaranteed-oriented” that prevents the risk of paving the way towards new European proceedings on the trial in absentia of the defendant.
