Abstract
The article analyzes Constitutional Court judgment No. 69/2025 on single-person access to medically assisted reproduction, framed by proportionality, the precautionary principle and the ECHR margin of appreciation. The Court holds that procreative self-determination is a standard for review rather than a subjective right to parenthood; it deems the current restriction of Law 40/2004 to couples not “manifestly disproportionate,” yet leaves room for a legislated, standards-based opening oriented to the child’s best interests. Systemically, the piece reads the ruling alongside No. 68/2025 (child’s status) and advocates replacing categorical presumptions with individualized assessments and transparent, reviewable procedures.
