Diritto privato e tutela dell’ambiente : the times they are a-changin

Abstract

The essay addresses the impact of the environmental issue (i.e. climate change and ecological transition) on the traditional categories of private law, with particular regard to property, contract and civil liability. It also deals with business law, underlining the role played by the recent amendments to articles 9 and 41 of the Italian Constitution on business organization and activity, which must now move within the limits of respect for environmental protection and for next generations.
