Abstract
The paper aims to analyze the impact that the evolution of the digital economy and the algorithmic society has had on the core traditional principles and categories of succession law. The research distinguishes issues concerning the succession of rights on the deceased’s personal data from the perpetuation of contracts for the provision of digital services and the transmission of IPRs concerning user-generated content. The study also investigates the new opportunities for the de cuius individual freedom in the digital realm, focusing on both the substance and the methods used, while seeking to settle the doctrinal legitimacy of the non-testamentary digital act of final wishes. In conclusion, the essay aims to design a unified yet multifaceted model of digital inheritance, classified under the category of ‘qualified’ succession.
