Abstract

The essay focuses on the contents of property rights in light of the recent ruling by the Joint Divisions of the Court of Cassation in August 2025. In this regard, it highlights the limitation on the possibility of invoking the concept of sustainability as a lever to introduce restrictions or counterbalances to the exercise of property rights. To this end, the author focuses on the (critical) insights offered by the condhotel contract.
