In this article, I will analyse some rationally unjustified arguments from Italian case law of the Supreme Court, the Constitutional Court, and the doctrine that explain the rationale behind the offence of so-called “surrogacy of motherhood” and that regulate the filiationis status of children born by gestation for others not in Italy
