Abstract
Starting from the idea according to which there is a process of humanization international law, this work aims to dismantle the dichotomy between justice and humanity present in certain assumptions of our legal culture. After that, attention is focused on the evolution of the international law of human rights and humanitarian law, where different meanings of humanity are identified: humanity as a universal title of rights, as the identification criterion of the bearer of the duties to protect rights, as the principle that commands the protection of human dignity of the enemies of humanity in international criminal justice, as the project to alleviate suffering during wars. It is argued that in the international context a way of understanding the relationship between justice and humanity that surpasses their dichotomous relationship emerges. Some difficulties and challenges to face are focused on.
