Abstract

«Ex chirographo ex stipulatu» agere · In the classical age, did the chirographs assume constitutive effects of the obligation ? This thesis, recently proposed, is examinated through the analysis of both texts adduced to support it and other legal sources that can be adduced in favour of the doctrine that traditionally attributes to chirographs mere evidentiary efficacy (at least up to and including the Diocletian’s age).
