Abstract

The subject of this paper concerns a cross-cutting issue that runs through many topics regarding the relationship between EU and domestic sources in their mutual influence and circularity: namely, the disapplication by the national judge of a domestic rule that conflicts with a rule of European Union law, in light of recent judgments of the CJEU and the Constitutional Court. This perspective highlights the crucial role played by the national judge in this context, as well as the challenges that may follow from the effects of such disapplication in particularly sensitive areas, notably criminal law.
