Abstract
This article analyses the influence of constitutional principles and fundamental rights on the validity of acts of private autonomy in the legal systems of Perù and Italy. Through an exhaustive analysis of each country’s internal regulations, it discusses whether constitutional judges have the power to declare civil acts null and void and whether such intervention affects the distinctionbetween civil and constitutional protection. It concludes that it is not necessary to create new grounds for nullity, but rather to apply a dynamic concept of public policy that allows for the integration of constitutional values without distorting the function of the amparo process or private autonomy.
