Il caso degli enti privati aderenti a religioni minoritarie. Tra eguaglianza e diversità di trattamento

Abstract

The question of the legal treatment of minority religions needs to face a number of issues, mainly concerning the equality and freedom of individuals and groups, the limits of majority democracy, tolerance, the object of rights and how to exercise them, the protection of pluralism and differences and, finally, the very meaning of law and the principles of legislation. In a globalised world, with a richly diverse population of different beliefs and with the advance of secularisation, the challenge of regulating coexistence is becoming increasingly difficult for the state to manage. With this in mind, the following pages attempt to provide a solution to the problem - specific but significant in terms of its potential methodological generalisability to similar issues - of the state treatment to be reserved to private bodies belonging to minority confessions
