CONSIDERATIONS ON THE PATENTABILITY OF NANOTECHNOLOGIES

Abstract

This article examines the development and current status of nanotechnologies in Europe and North America, with a particular focus on the interplay between nanotechnology regulation and intellectual property (IP) protection. It explores the unique characteristics of nanotechnologies, addressing key issues in patentability case law, such as novelty, inherency, and obviousness. The article also analyzes the implications of the existing regulatory and legal framework and offers a forward-looking perspective on the future of IP protection in the nanotechnology sector
