Dovere di difesa della Patria e patto sociale tra Amministrazione della difesa e cittadino: l’alba di una nuova responsabilità da c.d. “ingegneria sociale”?

Abstract

As is know, the exquisitely peculiar nature of the relationship between the Defense Administration and the citizen-military can be found in the so-called obedience “passive” of the latter, bound to fulfill the duties established by the general norms and to give immediate execution to the orders of the superior. In this scenario, the study, starting from the assumption according to which the Administration is required to compensate for the sacrifice suffered by the individual citizen for the correct pursuit of the collective interest (duty to defend the homeland), some reflections will be conducted around the nature of the responsability of the Administration of defense in the hypothesis in which the soldier were to suffer damage during the performance of his service, in particular following exposure to depleted uranium.
