Abstract

The right to silence, although being a long-term established principle in our criminal process, is currently going through a new evolutionary stage, as a result of a recent ruling of the European Court of Justice. The new judgment, delivered on instigation of the Constitutional Court, has extended the scope of the right to silence to the whole “criminal law” area. Indeed, this decision offers the opportunity to carry out a critical analysis of certain institutes of our criminal process which, also in the light of other systems’ practices, conflict with the protection of the nemo tenetur se detegere principle.
