Abstract

The essay analyzes the French case law related to the matter of wheater the clauses of jurisdiction and applicable law in a contract between an online platform and its affiliated economic operators is binding and enforceable also against the Ministre de l’économie et des finances in the context of an action based on cross-border practices restricting competition, such as those repre- sented by the imposition by Expedia of the Most Favoured Nation’s clause to its affiliated hotels.
