Abstract
The work aims to identify the typical elements of responsability from a legitimate act or lawful activity of the public administration and to understand whe-ther it qualifies as social contact liability, but so-called “atypical”, by virtue of the duty of solidarity, pursuant to art. 2 Constitution.
